Is a surrogacy agreement from abroad valid in the U.S.?

Signing a surrogacy agreement in another country doesn’t automatically settle things once you return to the U.S. Whether that contract protects you depends on where you live, where you go to court and what steps you take after the pregnancy. Here’s how U.S. courts look at surrogacy agreements made abroad.

Foreign contracts are not automatically valid in U.S. courts

A surrogacy agreement signed outside the U.S. does not automatically carry legal force here. Family law falls under state control, not federal law. That means each state decides whether it will recognize or ignore a foreign surrogacy contract. If the agreement conflicts with that state’s laws or public policy, the court can refuse to enforce it, even if everyone followed the contract overseas.

U.S. parentage must be established through a local process

A foreign surrogacy contract alone cannot establish you as a legal parent in the U.S. To secure parentage, you must go through a U.S. court process, such as a pre-birth order, post-birth order or adoption, depending on the state and the facts of the case. Until a U.S. court recognizes you as the parent, agencies and institutions may not treat you as one.

Some states are more surrogacy-friendly than others

California courts regularly handle international surrogacy cases and allow intended parents to obtain parentage orders even when the pregnancy or birth happens abroad. Other states lack clear surrogacy laws or restrict these arrangements, which can make parentage recognition slower and more complicated. If you live outside a surrogacy-friendly state, you may need to take extra legal steps or relocate the legal process to secure your rights.

Make sure your agreement stands where it matters

If you’re planning surrogacy outside the U.S., take steps early to protect your rights at home, not after the birth.
